The purpose of this Notice is to inform the building industry, and other interested persons, about permitting changes for seawall construction in South Gulf Cove. The Florida Department of Environmental Protection (FDEP) has agreed to allow Charlotte County Government to issue permits for seawall construction in South Gulf Cove subject to meeting certain permitting requirements which include, among other items, the following:
1. A survey prepared by a Florida licensed Professional Surveyor and Mapper delineating the canal R/W line (rear property line).
2. The most waterward face of the seawall shall be placed 0.5 feet landward of the canal R/W (rear property line).
3. Variances may be considered on a case-by-case basis. However, no portion of the seawall shall encroach the canal R/W.
The Charlotte County Board of County Commissioners approved the acceptance of permitting authority by way of a Consent Order at their Tuesday, September 22, 2015 meeting. Once filed with the designated clerk of the FDEP, permit applications may be accepted unless a timely request for an FDEP administrative hearing is filed by a third party.
