Construction Material Delivery and Storage

This is a reminder to the construction industry about the regulations concerning the delivery and storage of construction materials in the County right of way. We understand the current challenges the industry faces with material orders and delivery timeframes, but we are seeing an increased trend in utilizing the County right of way that is creating issues for many communities.


Florida Building Code Sections 3307 & 3308 and Charlotte County Code 3-5-94 state that construction material shall not be stored in drainage swales and County right of ways. The storing of these materials in County swales and right of way creates an unsafe condition for vehicular and pedestrian traffic and causes the damming of water resulting in the flooding of neighboring properties and roadways.

To resolve the current issues we are giving contractors and suppliers until September 15, 2022 to remove all construction material, equipment, dumpsters and porta johns from the drainage swales and right of way. If the items are not removed from the right of way, a County inspector will issue a stop work order until the property is in compliance. Please pass this message on to your material suppliers.
