Board Of Zoning Appeals

• Special Exceptions: The BZA may grant a Special Exception for a specific use within a zoning district when the use is identified as a Special Exception in the Zoning Code. Approval is based on competent, substantial evidence demonstrating that the proposed use will not be detrimental to traffic, public welfare, or public safety.
• Variances: Variances are site-specific approvals that allow for the relaxation of land development standards such as setbacks, building height, yards, or parking requirements. To approve a variance, the BZA must make affirmative findings on all five criteria contained in the Zoning Code. Due to the restrictive nature of these criteria, variances are less common than Special Exceptions.
• Appeals of Zoning Official Determinations: When an entity disagrees with a binding determination issued by the Zoning Official, an appeal may be brought before the BZA. Following a public hearing, the Board may affirm or reverse the determination based on competent, substantial evidence.

The Board of Zoning Appeals (BZA) meets every second Wednesday of the month in Room 119, 18500 Murdock Circle, County Administration Center, Port Charlotte at 9 a.m.
