Work in the Right-of-Way After the Effects of Hurricane Ian

MEMORANDUM

DATE: October 10, 2022

FROM: Joanne Vernon, PE, County Engineer

TO: Building and Utility Contractors

SUBJECT: Work in the Right-of-Way After the Effects of Hurricane Ian

Charlotte County is working through the recovery efforts left behind from Hurricane Ian. An emergency debris removal contractor is working to collect storm debris within County Right-of-Way (ROW); however, this process will take substantial time due to the amount of debris the storm produced.

As property owners work through their own recovery efforts, the possibility of additional debris along the roadside will continue. The quantity of debris throughout the County makes establishing a timeline for removal very difficult.

If contractors choose to work within County ROWs, the County takes no responsibility for the delays to construction or the impacts to the construction as a result of additional debris within the ROW. If a contractor removes the debris instead of waiting for the County’s contractor to remove the items, the contractor will be responsible for all costs and must dispose of the debris in a legal manner.
